These Terms of Use govern your use of youhealthgroup.com and any quote, enquiry or communication you make through it. The site is operated by You Health Group LLC (“You Health Group”, “we”, “us”, “our”), a licensed independent health insurance agency.

By using this site or submitting a request, you agree to these Terms. If you do not agree, please do not use the site.

1. We are an insurance agency, not the government

You Health Group LLC is a licensed independent insurance agency. We are not affiliated with, endorsed by, or acting on behalf of the United States government, the Health Insurance Marketplace^®, HealthCare.gov, the Centers for Medicare & Medicaid Services, the federal Medicare program, or any state or federal agency. This website is not the Health Insurance Marketplace website. To visit the federal Marketplace directly, go to HealthCare.gov.

We are licensed in Alabama, Arizona, Florida, Michigan, Mississippi, North Carolina, Ohio, South Carolina, Tennessee and Texas.

2. Who may use this site

You must be at least 18 years old and a resident of the United States to request a quote. If you are asking about coverage for other members of your household, you confirm you are authorised to give us their information.

3. What this site does and does not do

This site lets you request a quote and speak to a licensed agent. It is provided for general information and to start a conversation.

• Nothing on this site is an offer of insurance, a contract, or a binding quote.
• Nothing on this site is legal, tax, financial or medical advice. Whether a subsidy applies to you depends on your tax situation; consult a tax professional about your own circumstances.
• Only an insurance carrier can issue coverage. Only the Health Insurance Marketplace or the carrier can determine your final eligibility, premium and subsidy.
• Plan availability, benefits, provider networks and premiums vary by state, county, ZIP code, age, household size and eligibility, and change from year to year. Not all plans are available in all areas.

4. Quotes and estimates

Any premium, subsidy or savings figure shown to you or given by an agent is an estimate based on the information you provide at that moment. It is not a guarantee. Your actual premium and eligibility are determined by the carrier and the Marketplace when your application is processed, and may differ.

Submitting information through this site does not enroll you in coverage, does not guarantee eligibility, and does not guarantee any particular rate.

5. Your responsibilities

You agree to give accurate, current and complete information. Insurance applications rely on it, and giving false information on an application for health coverage may invalidate that coverage and may be unlawful.

If your circumstances change — income, household size, address, or a change to other coverage you hold — you are responsible for telling us or the Marketplace, because those changes can affect eligibility and subsidy.

6. Contact by phone, text and email

If you tick the consent box on our quote form, you give express written consent for us and our licensed agents to contact you at the number and email address you gave, including by automatic telephone dialing system, prerecorded or artificial voice, and SMS, even if that number is on a Do Not Call list. Consent is not a condition of purchase. Message and data rates may apply; message frequency varies. Reply STOP to opt out of texts, HELP for help.

How we handle what you tell us is set out in our Privacy Policy, which forms part of these Terms.

7. Third-party websites and services

The site links to third parties, including HealthSherpa, an authorised Marketplace enrollment platform, and to insurance carriers. When you follow those links you leave our site and are governed by their terms and privacy policies. We do not control them and are not responsible for their content, availability, security or practices.

8. Intellectual property

The content of this site — text, layout, graphics, logos and code — is owned by You Health Group LLC or its licensors and protected by United States copyright and trademark law. You may view and print pages for your own personal, non-commercial use. You may not copy, republish, scrape, resell or create derivative works from the site without our written permission.

Carrier names and logos are the trademarks of their respective owners and are shown to identify the plans we can offer. Their appearance does not imply that the carrier endorses this site.

9. Things you must not do

• Submit false information, or another person’s information without their permission.
• Use the site for any unlawful purpose, or to break insurance or telemarketing law.
• Attempt to gain unauthorised access to the site, its accounts or its systems.
• Use automated means to scrape, harvest or submit through the site.
• Interfere with the site’s operation, or upload anything malicious.
• Impersonate anyone, or misrepresent your association with any person or organisation.

10. Availability

We try to keep the site available but do not guarantee it will be uninterrupted or error free. We may change, suspend or discontinue any part of it at any time without notice.

11. Disclaimer of warranties

The site and its content are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the content is accurate, current or complete.

Plan information, premiums and benefit summaries shown on this site are provided for general guidance. The official plan documents issued by the carrier govern in every case.

12. Limitation of liability

To the fullest extent permitted by law, You Health Group LLC and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of the site — even if we have been advised such damages are possible.

Our total liability for any claim relating to the site or these Terms will not exceed one hundred US dollars (US$100).

Some states do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of the two paragraphs above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnity

You agree to indemnify and hold harmless You Health Group LLC and its officers, employees and agents from any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the site, or information you submit that turns out to be false.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Subject to the paragraph below, you and we agree that the state and federal courts located in Miami-Dade County County, Florida have exclusive jurisdiction.

Any dispute arising out of these Terms or your use of the site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court. You and we each waive any right to a jury trial and to participate in a class action. You may reject this arbitration agreement by writing to us within 30 days of first accepting these Terms.

Nothing here limits your right to complain to a state insurance regulator or attorney general.

15. Changes to these Terms

We may update these Terms. The “Last updated” date above will change when we do, and the updated version applies from the date it is posted. Continuing to use the site after that means you accept the change.

16. General

If any provision of these Terms is held unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the site. You may not assign them; we may assign them in connection with a merger or sale of the business.

Notice of non-discrimination

No individual applying for health coverage through the individual Marketplace will be discouraged from applying for benefits, turned down for coverage, or charged more premium because of health status, medical condition, mental illness claims experience, medical history, genetic information or health disability.
